Synthesis Demo License agreement
By downloading, using or installing Synthesis SyncML Demo Software
("Demo Software")
or any of its parts (such as documentation), you agree to all
of the terms of this agreement.
This is not free software. Subject to the terms below, you are hereby
licensed by Synthesis to use the Demo Software, for evaluation and test
purposes without charge.
You are allowed to give copies of the Demo Software to third parties under
the condition that not only the Demo Software itself, but all accompanying
documentation and other material, including this license agreement,
is included.
YOU ARE SPECIFICALLY PROHIBITED FROM USING DEMO SOFTWARE FOR ANY COMMERIAL
PURPOSE, INCLUDING CHARGING, OR REQUESTING DONATIONS, FOR ANY COPIES,
HOWEVER MADE, AND FROM DISTRIBUTING SUCH COPIES WITH OTHER PRODUCTS
OF ANY KIND, COMMERCIAL OR OTHERWISE, WITHOUT PRIOR WRITTEN PERMISSION
FROM SYNTHESIS AG.
All rights of any kind in Demo Software which are not expressly granted in
this License are entirely and exclusively reserved to and by Synthesis AG.
You may not rent, lease, modify, translate, reverse engineer, decompile,
disassemble, or create derivative works based on, Demo Software. You may
not make access to Demo Software available to others in connection with a
service bureau, application service provider, or similar business.
WARRANTY DISCLAIMERS AND LIABILITY LIMITATIONS
DEMO SOFTWARE, AND ANY AND ALL ACCOMPANYING SOFTWARE, FILES, DATA AND
MATERIALS, ARE DISTRIBUTED AND PROVIDED "AS IS" AND WITH NO WARRANTIES
OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
You acknowledge that good data processing procedure dictates that any
program, including Demo Software, must be thoroughly tested with
non-critical data before you rely on it, and you hereby assume the
entire risk of using the program.
THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE.
ANY LIABILITY OF SYNTHESIS AG WILL BE LIMITED EXCLUSIVELY TO REFUND OF
PURCHASE PRICE, IF ANY. IN ADDITION, IN NO EVENT SHALL SYNTHESIS AG, OR
ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS,
SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE
USE OF DEMO SOFTWARE, OR TO YOUR RELATIONSHIP WITH SYNTHESIS AG.
IN ADDITION, IN NO EVENT DOES SYNTHESIS AG AUTHORIZE YOU TO USE DEMO SOFTWARE
IN APPLICATIONS OR SYSTEMS WHERE DEMO SOFTWARE'S FAILURE TO PERFORM CAN
REASONABLY BE EXPECTED TO RESULT IN A SIGNIFICANT PHYSICAL INJURY,
OR IN LOSS OF LIFE. ANY SUCH USE BY YOU IS ENTIRELY AT YOUR OWN RISK,
AND YOU AGREE TO HOLD SYNTHESIS AG HARMLESS FROM ANY AND ALL CLAIMS OR
LOSSES RELATING TO SUCH UNAUTHORIZED USE.
